Welcome to Gym Career Central (“we,” “us,” or “our”), an online fitness hiring platform based in Boston, Massachusetts. We are committed to protecting your privacy and ensuring the security of your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform (the “Platform”), including our website, employer and candidate dashboards, and related services. By using the Platform, you agree to the terms of this Privacy Policy. If you do not agree, please do not use the Platform.

1. Information We Collect
We collect information to provide and improve our services, facilitate job postings, and connect fitness employers with job seekers. The types of information we may collect include:
  • Personal Information: Information that identifies you as an individual, such as:
    • For Employers: Name, email address, phone number, mailing address, business name, and company profile information (e.g., logo, description).
    • For Candidates: Name, email address, phone number, and resume (including work history, education, and fitness-related details).
    • Account login credentials (e.g., username, password) for both employers and candidates.
  • Payment Information: When employers purchase job packages (e.g., Welcome at $189, Single at $250, Triple at $650, 5X at $990, Corporate at $1750), we collect payment details such as credit card information or billing address. We use Stripe with WooCommerce as our third-party payment processor to handle transactions securely, and we do not store your full payment details on our servers.
  • Communication Data: Messages exchanged between employers and candidates via the Platform’s messaging system (integrated with the Cariera theme), as well as any communications with us via email or live chat for support.
  • Dashboard Activity: Actions taken within employer and candidate dashboards, such as job postings created, applications submitted, searches performed, and profiles viewed.
  • Usage Data: Information about how you interact with the Platform, such as:
    • IP address, browser type, device information, and operating system.
    • Pages visited, time spent on the Platform, and user interactions (e.g., clicks, searches).
    • We use Google Analytics (GA4) to collect and analyze usage data to understand how users interact with our Platform and to improve our services. GA4 may collect anonymized data such as page views, session duration, and user behavior (e.g., navigation patterns). This data is associated with a unique identifier but is not directly linked to your personal information unless you are logged into your account. We also maintain server logs managed by Bluehost for basic usage tracking.
  • Cookies and Tracking Technologies: We use cookies to enhance your experience (e.g., remembering login details) and maintain session data. Additionally, Google Analytics (GA4) uses cookies and similar tracking technologies (e.g., identifiers) to collect usage data. You can manage cookie preferences through your browser settings or opt out of GA4 tracking as described in Section 5.
 
2. How We Use Your Information
We use the information we collect for the following purposes:
  • To Provide and Operate the Platform:
    • Create and manage user accounts for employers and candidates.
    • Enable employers to create company profiles and post jobs using purchased packages (e.g., Welcome, Single, 5X, Triple, Corporate).
    • Allow candidates to search for and apply to jobs.
    • Facilitate direct messaging between employers and candidates within dashboards using the Cariera theme’s messaging feature.
    • Process payments securely through Stripe with WooCommerce.
  • To Communicate with You:
    • Respond to inquiries via email (with a 1-3 hour response time for Single plan users) or live chat (available for Triple, 5X, and Corporate plan users).
    • Send transactional emails (e.g., payment confirmations, application notifications, message alerts).
    • Send promotional emails or newsletters about new features or job opportunities (you can opt out at any time).
  • To Improve Our Services:
    • Analyze data collected via Google Analytics (GA4) and server logs to understand user behavior, optimize Platform functionality (e.g., improving job search or dashboard usability), and measure the effectiveness of our services.
    • Monitor and troubleshoot technical issues within dashboards.
  • To Ensure Security and Compliance:
    • Detect and prevent fraud, spam, or unauthorized access (e.g., securing messaging and payment systems).
    • Comply with legal obligations, such as responding to law enforcement requests or maintaining records under Massachusetts General Laws Chapter 93H.
  • To Personalize Your Experience:
    • Recommend relevant jobs to candidates or candidates to employers based on activity (e.g., search history, applications, or GA4-derived insights).
    • Highlight featured listings or company profiles (e.g., for Triple and Corporate plans)
 
3. How We Share Your Information
We do not sell your personal information. We may share your information in the following circumstances:
  • Between Employers and Candidates: When a candidate applies to a job, their application details (e.g., resume, contact information) are shared with the employer who posted the job. Messages sent via the Cariera theme messaging system are visible to both parties in their dashboards.
  • With Service Providers: We use third-party service providers to support our operations, such as:
    • Google Analytics (GA4) to analyze usage data and improve our Platform. GA4 may process data such as IP addresses, device information, and user behavior, which may be stored on Google’s servers in the United States or other countries. Google is bound by its data processing agreements to protect your data.
    • Stripe with WooCommerce to process payments.
    • Bluehost to host our domain and store data on our WordPress servers in the US.
    • These providers are bound by confidentiality agreements and are only permitted to use your data to provide services to us.
  • For Legal Reasons: We may disclose your information if required by law, such as to comply with a subpoena, court order, or other legal process, including under Massachusetts General Laws Chapter 93H, or to protect our rights, property, or safety.
  • Business Transfers: If we are involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change.

4. How We Protect Your Information
We take reasonable measures to protect your information from unauthorized access, loss, or misuse, in compliance with Massachusetts data security regulations (201 CMR 17.00), including:
  • Using encryption (e.g., SSL/TLS) to secure data transmission, including messaging within dashboards and payment processing.
  • Storing data on our WordPress servers hosted by Bluehost in the United States, with access controls and regular backups.
  • Implementing security updates and monitoring for vulnerabilities. However, no system is completely secure, and we cannot guarantee the absolute security of your information. You are responsible for keeping your account credentials confidential and using strong passwords.

5. Your Choices and Rights
You have certain rights regarding your personal information, depending on your location and applicable laws (e.g., CCPA, GDPR, Massachusetts law):
  • Access and Update: You can access and update your account information, company profile, or candidate details by logging into your dashboard.
  • Delete: You can request deletion of your account and personal data by contacting us at [email protected]. We will process your request within 30 days, subject to legal obligations to retain certain data (e.g., payment records for auditing).
  • Opt-Out:
    • You can opt out of promotional emails by clicking the “unsubscribe” link in any email or contacting us. You cannot opt out of transactional emails (e.g., application notifications).
    • You can opt out of Google Analytics (GA4) tracking by using the Google Analytics Opt-Out Browser Add-On (available at https://tools.google.com/dlpage/gaoptout) or by managing cookie preferences through your browser settings to block GA4 cookies.
  • Cookies: You can manage cookie preferences, including those used by Google Analytics (GA4), through your browser settings. Note that disabling cookies may affect the functionality of the Platform.
  • CCPA Rights (California Residents): You have the right to know what personal information we collect, sell, or share, and to request deletion of your data. We do not sell your personal information. You can also request non-discrimination for exercising your rights. GA4 data collection is considered a “business purpose” under CCPA and not a sale of data.
  • GDPR Rights (EU Residents): If you are in the EU, you have the right to access, rectify, erase, restrict, or object to the processing of your data, including data processed by Google Analytics (GA4), and the right to data portability. You can also lodge a complaint with a supervisory authority.

6. Data Retention
We retain your information for as long as necessary to provide our services and fulfill the purposes outlined in this Privacy Policy, or as required by law:
  • Account data (e.g., employer profiles, candidate resumes) is retained while your account is active. If you delete your account, we will remove your personal information within 30 days, except for data we must retain for legal or auditing purposes (e.g., payment records under Massachusetts law).
  • Job postings and application data are retained for the duration of the posting (e.g., 30-45 days, depending on your plan) and up to 6 months afterward to allow for hiring processes, unless you request earlier deletion.
  • Messages in dashboards (via Cariera theme) are retained for 1 year after the last interaction, unless deleted earlier by both parties.
  • Usage data (e.g., server logs) is retained for up to 2 years to improve our services.
7. Third-Party Links and Services
The Platform may contain links to third-party websites or services (e.g., Stripe with WooCommerce, fitness certification bodies). We are not responsible for the privacy practices of these third parties. We encourage you to review their privacy policies before providing any information.
8. Children’s Privacy
Our Platform is not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 16. 9. International Data Transfers
We are based in Boston, Massachusetts, and your information is stored and processed on our WordPress servers hosted by Bluehost in the United States. We do not use cloud software for data storage. If you are located outside the US (e.g., in the EU), your data may be transferred to the US. We take steps to ensure that your data is protected in accordance with this Privacy Policy and applicable laws, such as using standard contractual clauses for EU data transfers. By using the Platform, you consent to this transfer.

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of significant changes by posting the updated policy on the Platform and updating the “Last Updated” date at the top. Your continued use of the Platform after such changes constitutes your acceptance of the revised policy.
